It is that time again. Winter is officially among us. Often, renters are left with many unanswered questions on handling common occurrences and issues. Know that you are not alone. Get ready for the cold and the problems that are inherent in the winter weather conditions. Here are some common renter issues that arise in winter and how to handle them.

All Things Heat Related

It isn’t unheard of for landlords to only allow the heat to be on when it hits a specific date in the year, regardless of the outside temperature. However, this is not legal. The rooms should be able to maintain a minimum of 67 degrees. If you have issues with this, you may need to call the building inspector.

Keep in mind that landlords must disclose utility information before moving in. If they add electric heaters which impact your utility bill, you can ask that the difference in utility cost is covered.

Also, excessively drafty windows and doors must be cited. If you are having waterproofing issues that are not being addressed, you have every right to contact the building inspector.

Snow and Ice Problems

You must have a clear understanding of who is responsible for shoveling snow and ice. If it is up to you to keep sidewalks clear, the lease should state this. If you are leasing the grounds (not just the interior), it is most likely your responsibility to tend to the yard and sidewalk areas. With common spaces in an apartment complex, it is unlikely it says anything about you shoveling snow or removing ice in the contract.

Regardless, it is wise to know the local snow and ice laws. Snow should be typically cleared within 24 hours of falling to prevent hazards.

Some landlords are very particular about getting driveways and parking lots plowed, which then causes tenants to become frustrated if they are ticketed or towed from the lot. Be sure to understand the plowing and towing lease terms. You should contact your landlord in writing if you feel you were treated unfairly.

Other Considerations

Cold weather commonly draws pests inside. Building inspectors will need to be shown evidence of the pests in order to take action. Figure out their entry point to help track them down.

When it’s cold outside, it is common for smokers to start smoking inside. If you have issues with smoke, document that in advance if possible. Landlords should take your concerns seriously.
